Recovery of an Advance Payment for Undelivered Goods under a Foreign Trade Transaction
Representation of a Japanese company before Russian state commercial courts at several instances in proceedings concerning the recovery of unjust enrichment in the form of advance payments made under terminated international sale of goods agreements with a Russian purchaser.
Solution
The work included analysis of foreign trade contracts for the supply of seafood, determination of the applicable law, including the 1961 Vienna Convention on Contracts for the International Sale of Goods, development of the client’s legal position, preparation of procedural documents and participation in court hearings.
Negotiations concerning a potential settlement agreement were also conducted, and the Russian counterparty’s proposals were reviewed from a legal perspective.
Result
The matter was resolved favorably for the client. All communications with the client were conducted in English.
